The Honorable Joseph P. Russoniello
United States Attorney, Northern District of California
11th Floor, Federal Building
450 Golden Gate Avenue, Box 36055
San Francisco, California 94102
Dear Mr. Russoniello:
This Firm represents Move America Forward, Inc. (hereinafter "MAF"), a non-profit organization committed to supporting members of the United States Armed Forces and their families.
Our client participated in what began as a peaceful demonstration in support of the United States Marine Corps Recruiting Center, located on Shattuck Avenue in the City of Berkeley, on February 12, 2008. MAF obtained a permit from the City of Berkeley prior to the demonstration. Sadly, the peaceful demonstration was disrupted with violence. During the demonstration, several incidents occurred which the Berkeley Police Department failed to respond to adequately. MAF supporters were harassed, threatened, and intimidated by opposing groups. In addition, several acts of violence were committed against MAF supporters, and the Berkeley Police Department ignored their repeated requests for assistance. The police failed to protect its citizens during what should have been a peaceful demonstration. These incidents of intimidation, violence, and government inaction were widely reported in both the Bay Area and national media.
Our client also remains concerned that recent legislative action by the Berkeley City Council, which ultimately precipitated the unfortunate events of February 12, 2008, runs afoul of federal law. As you are likely aware, the Berkeley City Council approved a resolution on January 29, 2008, that provided in pertinent part that "the Marine recruiting office is not welcome in [Berkeley], and if recruiters choose to stay, they do so as uninvited and unwelcome intruders....". The Council then resolved to "encourage all people to avoid cooperation with the Marine Corps recruiting station, and applaud residents and organizations such as Code Pink, that may volunteer to impede, passively or actively, by nonviolent means, the work of any military recruiting office located in the City of Berkeley." The legacy of this "encouragement" was the shameful events that transpired in Berkeley on February 12, 2008.
The City of Berkeley is actively, through the legislative action by the City Council, encouraging private organizations to disrupt the lawful governmental operations of the United States in the City of Berkeley, by encouraging groups to "impede" the efforts of the United States Marine Corps to recruit qualified young people to serve in the Corps. There is little question that Berkeley, as a college town, is an appropriate place for the Marine Corps to recruit qualified, patriotic young people to serve their country as United States Marines. By encouraging disruptive behavior patently calculated to drive the Marine Corps out of the City of Berkeley, the City Council appears to be soliciting unlawful, and quite possibly criminal, interference with the lawful operations of a federal agency operating within the City of Berkeley.
We hereby request an investigation into the timely lack of response by the City of Berkeley and the Berkeley Police Department during the events of February 12, 2008. In short, the City of Berkeley failed to protect its citizens engaged in the lawful exercise of their rights under both the First Amendment and federal civil rights laws. As you know, these laws fully protect our client's right to participate in such peaceful expression, and they have the right to be protected from such acts of violence. Further, Move America Forward requests that your office inquire into the legal propriety under applicable federal law of the efforts of the City of Berkeley to "encourage," through legislative action, organizations actively committed to undermining the ongoing military operations of the United States both at home and abroad to impede the lawful activities of a federal agency operating within the city limits.
Thank you in advance for your attention to this matter.
Sincerely,
SWEENEY & GREENE LLP

"I'm a second-generation Marine!" he yelled as he revealed his pink coat, which he wore with light pink pants with a dark pink military stripe. He said later in an interview that he had not in fact been a Marine, but his father and brother had. "We love the Marines! We want to bring them home!"
Melanie Morgan, Chairman of Move America Forward, said that the hostile actions of those who disrupted the news conference goes to the point of "The Sedition Report." "These are the same types of actions these individuals have engaged in at recruiting centers such as the one at 14th and L in Washington, D.C. and Berkeley, California. They storm the office, disrupt the actions of recruiters, commit acts of vandalism, and occupy the offices."
On Wednesday, March 19, POG will be holding a torch-lit march to a modern day castle of abominations—our local military recruiting station. If the station remains open, we intend to evict it and everything inside of it, occupy the location, and transform it into something useful for the community. We'll also be bringing a movable cage in which to confine military recruiters until they no longer pose a danger to our friends and neighbors.
wow. very cool
1 down! thousands to go! This is some awesome news to wake up to!
i caught this on the Seattle news last night ans was very excited to hear about it. although i thought it was more local, its of course still inspiring. thank you.
Bravo! Usually I\’m not a big supporter of vandalism, but I love to hear people sticking it to the government, and especially the military, like this. Good job!
holy smoke! this is great! good job!
hehe excellent we need to see more of this!

Dear Move America Forward Family,
I am writing this note to give you the news that you will no longer be hearing me on KSFO radio as part of the long running "Lee Rodgers and Melanie Morgan Show". Since we've worked together in the pro-troop movement, I wanted to make sure you were told firsthand before the news hit elsewhere.
Citadel Broadcasting, which recently acquired the ABC Radio Group - including KSFO radio, is undergoing some major financial problems, and is involved in a company-wide cost-cutting campaign. Sadly, the decision not to renew my contract is part of their cost-cutting effort. Monday, March 3, 2008, marked my last day on the airwaves at KSFO.
It has been my honor to speak to so many of you every morning for the past 14 years on KSFO as we built a conservative movement to take on radical liberals and their attacks on our brave men and women who serve this country in the U.S. military.
I want you to know something very important, and please pay close to attention to this: our very important work supporting our troops is not done, and don't think for a minute that I will give up the work we do here at Move America Forward. We've only just begun, folks!
I've never been paid a single penny in compensation for my work with Move America Forward. I do this work for free because I believe so passionately in our men and women who put on the uniform of the U.S. military and serve with honor, integrity and distinction.
Having seen our troops in the Middle East in action several times now (going all the way back to the Beirut Marine Barracks bombing in 1983 and most recently this past Christmas with our troops fighting in the war on terror), I have been deeply touched by the dedication these fine young men and women have in fighting radical Islamic jihadism.
Our troops are literally saving our children's future, and we cannot back down in our efforts in the pro-troop movement - not even for a day.
While I will miss my morning show on KSFO and my ongoing dialogue with loyal listeners, I now will have extra time and energy to support our troops. That's good news for our troops and bad news for those insult them and attempt to undermine their missions.
You can help me continue to make an impact in this regard by making a contribution to Move America Forward.

I'm not done fighting to make a difference in this world, and I will be honored to fight by your side in honor of our military men and women who fight to preserve our liberties and protect our lives.
Melanie Morgan, Chairman, Move America Forward
Move America Forward's Melanie Morgan is one of my favorite conservative activists. She's led countless battles against anti-military goons in the San Francisco Bay Area, traveled to Iraq to bring thank you letters to our servicemen and servicewomen on the front lines, and crossed the country to lead rallies in Washington, D.C. countering the Soros mob. [...]EAGLES UP!!

An announcement that is obviously calling themselves "Funk the War:"Join us for Counter-Recruitment this Friday, February 22nd at our new location at the U.S. Navy Recruitment Center!
Join CODEPINK outside of the Navy Recruitment Center in Santa Monica! Wear your pink for peace as we gather to spread the anti-war message and to educate the public about the risks associated with military recruitment and why it’s smart to OPT OUT. To attend, meet us outside our new location at the U.S. Navy Recruitment Center located at 2708 Wilshire Blvd. in Santa Monica (90403) at 12 noon this Friday the 22nd. Let’s show our support for Berkeley and let everyone know that Santa Monica is still in the running with Counter-Recruitment!
Let us know you’re coming by contacting Sarah at 310.827.4320 or la@codepinkalert.org
Pass the word along, contact people you know who live in these areas and let's put patriotic American men and women out there in numbers to counter these people and send them home. If you live in other areas where you see this sort of thing happening, LET US KNOW and we'll make sure the word gets out. After many previous protests had found the 14th st recruiter “closed” at 5PM, Funk the War found them open, and the door unlocked at nearer to 6Pm and promptly exploited the situation by demonstrating to them first hand how an occupying force behaves.
After a loud commotion inside while outnumbered cops watched, recruiters finally managed to get protesters to leave-but not before literature and full-body length cardboard displays in the street window area were destroyed. In addition, hundreds more “Funk the War” stickers were plastered all over just about everything that would take them. By the time everyone was out it looked like a tornado had swept through the lobby.
One recruiter tried to grab an activist but found himself overpowered by SDS’s superior strength and numbers and had no choice but to give up!
This came on the heels of the whole group marching in K st and Connecticut Ave at the height of rush hour, closing War Profiteer’s Row to cars fro quite a while. The group closed out by going after DC GOP headquarters, but that door was locked and there were too many cops around to break it down.

Dan Sorkin (a great friend of KSFO Radio and former DJ) forwarded this e-mail from the newly joined ranks of Berzkeley Boycotters! Now THAT'S what I'm talking about right there! HOOAH? As my DI used to say, "OUTFRIGGINSTANDING!"
Berkeley clerk to Marine Corps: You're Not Welcome
BERKELEY, Calif. Local officials in this liberal city say it's time for the U.S. Marines to move out.
The City Council has voted to tell the Marines their downtown recruiting station is not welcome and 'if recruiters choose to stay, they do so as uninvited and unwelcome guests.'
The measure passed this week by a vote of 8-1.
Now check this out, here is a letter a businessman wrote to the Mayor of Berkeley. Is this a great country or what?Dear Mayor Bates,In that you and your city have chosen to gravely insult the brave men and women, who have indeed bought you that right with their blood, I am informing you that my company will no longer do business with any of our current suppliers located in the Berkeley, California metro area.
In that my company is in international resort real estate development, and do business with and am associated with, developers and investors worldwide, I am informing all of my contacts, associates and patrons that we will no longer do any business of any sort with anyone living in the Berkeley area.
In that we/MDG Resorts are currently building a state of the art mega-yacht marina, all of the suppliers of Marina equipment, all owners of Yachts, all suppliers of Yacht materials & supplies, all yacht brokers and all tangential yacht business purveyors will likewise be informed that we will not do any business whatsoever with anyone from the Berkeley area.
Likewise all suppliers of building materials, both interior and exterior, currently associated with any of our several resort developments (Brisamar 300+ villas and 200+ condos: Porto Hussong, 500+ condos, 180 slip mega-yacht marina) both of which I might add have international recognition by virtue of glowing reports in Robb Report, Wall Street Journal, Yacht World, Forbes.
I will likewise inform all of our investors, most of whom are very wealthy yacht owners, casino owners, high net worth international businessmen, of our decision to essentially boycott all products and providers located in, or associated with in any way whatsoever, Berkeley, Ca.
Trust me when I say that having been in the real estate development business for over 35 years, our list of contacts and associates is long and very, very impressive. We, and I personally, are going to recomend that they ALL along with us boycott your city, its purveyors, suppliers, and businesses and CHARITIES of every kind.
You have every right to choose to take the obnoxious anti-military stance you have taken, and as stated, that right was bought for you with the blood of better men than you.
I too have every right to do all that I can to insure that your city suffers consequences arising from that obnoxious, sickening stance.
Cordially,
Brian G Dennard
Good Morning "Code Pink Corps"
Our company has just completed an analysis of the funds we have spent during 2007 within the city limits of Berkeley. The number was larger than I expected: $230,716. This amount is broken down in the following categories:
Meals and meeting expenses: $43,807; Printing, copies and imaging services: $36,954. Shipping expenses $18,534; temporary employment $103,954; Office supplies and equipment purchases: $27,467.
Our expenses above in Berkeley increased by about 12% this past year. We have budgeted a similar increase for 2008.
Because of the actions of "CodePink" and the Berkeley City Council we find that we must now exercise our 'freedom to act' and not do business within the City of Berkeley any longer. Over the next five years, the City of Berkeley will lose just from our organization from $1.4 to $1.7 million in business.
We will still grow our business successfully but we will fulfill our service needs, including meals and meeting expenses, at locations OTHER THAN BERKELEY. We are also encouraging our colleagues and business associates to do the same. Many will not be as direct as we are in communicating to you our actions.
While we regret that this action will hurt many worthy individuals and businesses in Berkeley, we are sure to gain a more friendly business environment elsewhere as our business continues to thrive. Gee, ain't freedom and free markets great?
You've made your decisions ... we have made ours.

It's a huge, stunning shift in the polls that is undoubtedly going to shake up the 2008 elections. You will have to wander over yonder to read the rest...
From down 21 percent to now up by 6 percent the new polls (just released) show the swing in momentum, one that has been remarkable by the media's silence on the matter. The tectonic swing in public opinion is taking place under radar and no one is talking about it.
So which candidate is it that has seen this singular 27 percent jump in the polls? [...]

Starting Monday, November 26th, Move America Forward will wage a huge, cross country pro-troop holiday tour called "Honoring Heroes at the Holidays Tour."
We'll have pro-troop rallies and events in 40 cities across America for the next three weeks, and at each event we'll collect signed Christmas, Hanukkah and holiday greeting cards that we'll deliver to our troops in Iraq and Afghanistan . We're collecting over 100,000 cards in this effort - and given the current rate the cards have been coming in to our headquarters at Move America Forward we could well exceed that goal.
I have a request to make of you: can you please help us spread the word of this effort and a link to our tour route so patriotic Americans all across the nation can do their part to show their support for our troops who will be serving more than 7,000 miles away from their families, friends and homes during the holidays.
When the "Honoring Our Heroes at the Holidays" national pro-troop tour ends on December 16th (in New York City), Move America Forward will then have a delegation fly to Iraq and hand-deliver the final batch of cards to our troops on Christmas Day.
We want to bring out great crowds to these events and collect huge numbers of Christmas/Hanukkah/Holiday cards for our troops.
PLEASE HELP GET THE WORD OUT!
Complete details can be found online at: Move America Forward

On Tuesday, November 13th, Move America Forward (website: http://www.MoveAmericaForward.org ) hosted the first event in what will be a 40-city cross country pro-troop tour to rally the American public to support our troops and their missions.
Along the way we're asking the public (including you) to help us collect and send over 100,000 Christmas, Hanukkah and holiday cards to our troops. The media coverage we got from our first event was outstanding - some of the best reporting you'll see about our troops in Iraq and Afghanistan.
Please spread the word on these reports below. And help us collect those 100,000 cards for our troops during the Christmas and Hannukah holiday season.

And, we even have some pictures from Dean...LOL. Well I'm a little late with this but here goes.Long drive up and physically taxing. I arrived early and reconnoitered the area to locate enemy encampments and patrols. None sighted at 07:00. Moved position to locate the main body of friendly forces at Holiday Inn Express. They were there so after a short break and head call for me and the dog I returned to the area of operations at Mills Park. Another recon revealed no enemy activity at 07:45. Two groups of friendlies were found so I mustered them to roll call and helped with planning. Assisted these people setting up a couple of booths, flags, tents, and established a perimeter. Another recon indicated enemy activity was light and well away form our camp.08:30 many friendly forces begin arriving. Reconned the perimeter once more and picked up one lone moonbat carrying a sign that read, "End The War - Out of Iraq Now". He attempted to infiltrate the camp but was stopped before he could do damage by me. I confronted the aging hippie who, by the way, smelled of goats, ganja, and feces. Yellow teeth too. He made several attempts to go around my confrontation but I countered moving swiftly to head him off each time. He was told by me that he was not welcome here and was not invited to this party. He screamed I was infringing on his 1st Amendment rights to which I responded "Get your sorry smelly ass out of here". He made one more attempt to get by me by getting in my face using his sign as a shield. Once again I stopped him with a stern warning, "Get the sign out of my face and go away before I take "that" sign and shove it up your ass." He began frothing at the mouth screaming more unintelligible raves about 1st Amendment rights and being threatened.
For some reason he suddenly turned away and exited the area in much haste. Thinking I had won a major firefight all by my lonesome, I turned to go back to camp and was immediately met by 8 or 9 friendlies all laughing their asses off. They congratulated me laughing, shaking hands stating "We had your back bro." The enemy infiltrator never returned.
This ends military after action report.Let the festivities begin. (to be continued)(Continued)Man what a day! All major players showed up at the scheduled time 09:00 including Duncan Hunter who was apparently on his way east. Perhaps pictures will show more than I can say, see attached.I had the honor to meet Debbie Lee, Duncan Hunter, Debborah Johns, Col. "Buzz" Patterson and was able to speak with them for a brief period. Amazing people and well motivated! After a few minutes of friendly chat I once again returned to the perimeter to check enemy positions. See attached.According to some reports there were over 200 friendlies and around 40 or so protesters. My assessment was at least 170 friendlies and 12 enemy counted. All in front of hairy "dickweeds" office on our side of the road. If there were more enemies they remained in the shadows and undetected. We had them outnumbered at least 14 to 1. And it goes without saying outclassed.I am always impressed by the conduct of our people. They are clean, well groomed, well spoken and fired up. Lots of happy faces and lots of Red, White, and Blue. HOOYAH! My kind of people...PATRIOTS everyone of them. The return trip was delayed by at least an hour due to heavy traffic...bumper to bumper for at least 100 miles.
(cont)
No major incidents to report in Sacramento as the caravan arrived and continued with the festivities.Moonbats had vandalized and defaced the Vietnam Veterans Memorial on the Capitol grounds. Volunteers were busy cleaning up the mess and today I am headed back there to help. Apparently the damage was done in the wee hours or late night and went undetected by police patrolling the grounds. Coffee break perhaps? The dribbling little creeps aren't stupid so they probably had lookouts. From the looks of the damage it was done quickly with no method to the madness. Damage was minor but ugly. I didn't take pictures mainly because I don't want to be reminded of the incident. The news stations have it recorded.
Returned home checked e-mail and visited your blog and Spree's to make sure that she was able to live blog the event. I checked in with Deb Johns and another lady to make sure Spree was on the list for live updates and pictures. Could not enlist any additional volunteers to aid in the effort but didn't spend alot of time at it considering
I was just a little bit busy with perimeter control. LOL.I begged the moonbats to move a little closer and they responded by moving further away except for two brave mindless wonders who were picked up by others on patrol. I got pictures of these two fools..."We Support The Troops - Bring Them Home Now." Fucking idiots..........
