As for the first fifth that is taken from the spoils, it is divided in turn into five parts, a share each going to:

-1- the Prophet (Allah bless him and give him peace), and after his death, to such Islamic interests as fortifying defenses on the frontiers, salaries for Islamic judges, muezzins, and the like;

-2- relatives of the Prophet (Allah bless him and give him peace) of the Bani Hashim and Bani Muttalib clans, each male receiving the share of two females;

-3- orphans who are poor;

-4- those short of money (def: h8.11);

-5- and travellers needing money (h8.18).





Bottom Line:
  • Why does the 'religion of peace' have a legal ruling on the division of spoils?
  • Why do 8:1 and 8:41 exist in the Qur'an?
  • Why does this hadith exist?
Muslim Book 019, Number 4327:
The spoils of war were not made lawful for any people before us, This is because Allah saw our weakness and humility and made them lawful for us.
It is time to pull your head out of your anal orifice, wipe the drek from your eyes, and take a clear eyed look at objective factual reality. You have been lied to; fed excrement and you swallowed it. Islam is not a religion of peace. It is not a religion. Islam is permanent war.

Ibn Kathir, in his Tafsir, which explains the meaning of the Qur'an, rolls the Qur'an & Hadith together with extreme clarity. Here, once more, is a concentrated list of the most relevant Tafsir topics. Click the links and read them all for review.
None of that is consistent with 'religion of peace'; not the orders to fight, not the promise of world domination.
Islam is not peace, it is permanent war until we are dead or subjugated and extorted. The previous sentence contains a link to an ebook, written by an Indian radio journalist, which documents the same facts brought out in this series.

As for personal booty, anyone who, despite resistance, kills one of the enemy or effectively incapacitates him, risking his own life thereby, is entitled to whatever he can take from the enemy, meaning as much as he can take away with him in the battle, such as a mount, clothes, weaponry, money, or other.

Chapter O10.0: The Spoils of Battle

O10.1

A free male Muslim who has reached puberty and is sane is entitled to the spoils of battle when he has participated in a battle to the end of it.

After personal booty (def: o10.2), the collective spoils of the battle are divided into five parts. The first fifth is set aside (dis: o10.3), and the remaining four are distributed, one share to each infantryman and three shares to each cavalryman. From these latter four fifths also, a token payment is given at the leader's discretion to women, children, and non-Muslim participants on the Muslim side.A combatant only takes possession of his share of the spoils at the official division. (A: Or he may choose to waive his right to it.)

Bottom Line: What need has the 'religion of peace' for legal rulings on the division of spoils of war?

O9.16: Truces

(O: As for truces, the author does not mention them. In Sacred Law truce means a peace treaty with those hostile to Islam, involving a cessation of fighting for a specified period, whether for payment or something else. The scriptural basis for them includes such Koranic verses as:

-1- "An acquittal from Allah and His messenger..." (Koran 9:1);

-2- "If they incline towards peace, then incline towards it also" (Koran 8.61);

as well as the truce which the Prophet (Allah bless him and give him peace) made Quraysh in the year of Hudaybiya, as related by Bukhari and Muslim.

Truces are permissible, not obligatory. The only one who may effect a truce is the Muslim ruler of a region (or his representative) with a segment of the non-Muslims of the region, or the caliph (o25) (or his representative). When made with other than a portion of the non-Muslims, or when made with all of them, or with all in a particular region such as India or Asia Minor, then only the caliph (or his representative) may effect it, for it is a matter of the gravest consequence whether globally or in a given locality, and our interests must be looked after therein, which is why it is best left to the caliph under any circumstances, or to someone he delegates to see to the interests of the various regions.

There must be some interest served in making a truce other than mere preservation of the status quo.

Allah Most High says,

"So do not be faint-hearted and call for peace, when it is you who are the uppermost" (Koran 47:35).

Interests that justify making a truce are such things as Muslim weakness because of lack of members or materiel, or the hope of an enemy becoming Muslim, for the Prophet (Allah bless him and give him peace) made a truce in the year Mecca was liberated with Safwan ibn Umayya for four months in hope that he would become Muslim, and he entered Islam before its time was up. If the Muslims are weak, a truce may be made for ten years if necessary, for the Prophet (Allah bless him and give him peace) made a truce with Quraysh for that long, as is related by Abu Dawud. It is not permissible to stipulate longer than that, save by means of new truces, each of which does not exceed ten years.

The rulings of such a truce are inferable from those of the non-Muslim poll tax (def: o11); namely, that when a valid truce has been effected, no harm may be done to non-Muslims until it expires.)

Bottom Line: It is ok to destroy the assetts which make life possible for your victims, their crops and their shelter. Why in Hell does the 'religion of peace' have such rulings in its canon of jurisprudence?

When an adult male is taken captive, the caliph (def: o25) considers the interests (O: of Islam and the Muslims) and decides between the prisoner's death, slavery, release without paying anything, or ransoming himself in exchange for money or for a Muslim captive held by the enemy.

If the prisoner becomes a Muslim (O: before the caliph chooses any of the four alternatives) then he may not be killed, and one of the other three alternatives is chosen.
Bottom Line: Why does the 'religion of peace' have a legal ruling on prisoners of war? Why is it so detailed?
Why does the "religion of peace" have a legal ruling on captive women & children? The incongruity stands out like a pig's snout.

The caliph fights all other peoples until they become Muslim (O: because they are not a people with a Book, nor honored as such, and are not permitted to settle with paying the poll tax (jizya) ) (n: though according to the Hanafi school, peoples of all other religions, even idol worshippers, are permitted to live under the protection of the Islamic state if they either become Muslim or agree to pay the poll tax, the sole exceptions to which are apostates from Islam and idol worshippers who are Arabs, neither of whom has any choice but becoming Muslim (al-Hidaya sharh Bidaya al-mubtadi' (y21), 6.48-49) ).

Bottom Line: What does the Caliph do?
  • The caliph fights all other peoples until they become Muslim
The Caliph makes war upon 'people of the book' and he fights all other peoples until they become Muslim or dead.

That is Islamic law, God damn it! Islam, as defined by:
  • its scripture: the Qur'an
  • its tradition: the Hadith
  • its law: the Sharia
is not a religion, it is permanent war!
When do those orders expire?

Abu Dawud Book 14, Number 2526


Narrated Anas ibn Malik:

The Prophet (peace_be_upon_him) said: Three things are the roots of faith: to refrain from (killing) a person who utters, "There is no god but Allah" and not to declare him unbeliever whatever sin he commits, and not to excommunicate him from Islam for his any action; and jihad will be performed continuously since the day Allah sent me as a prophet until the day the last member of my community will fight with the Dajjal (Antichrist). The tyranny of any tyrant and the justice of any just (ruler) will not invalidate it. One must have faith in Divine decree.
Jihad continues from 610 to the end of the world. What happens if the Muslims discontinue Jihad in favor of more productive pursuits?

Abu DawudBook 23, Number 3455:

Narrated Abdullah ibn Umar:

I heard the Apostle of Allah, (peace_be_upon_him) say: When you enter into the inah transaction, hold the tails of oxen, are pleased with agriculture, and give up conducting jihad (struggle in the way of Allah). Allah will make disgrace prevail over you, and will not withdraw it until you return to your original religion.

Allah will curse them if they abandon Jihad.

O9.8: The Objectives of Jihad

The caliph (o25) makes war upon Jews, Christians, and Zoroastrians (N: provided he has first invited them to enter Islam in faith and practice, and if they will not, then invited them to enter the social order of Islam by paying the non-Muslim poll tax (jizya, def: o11.4) -which is the significance of their paying it, not the money itself-while remaining in their ancestral religions) (O: and the war continues) until they become Muslim or else pay the non-Muslim poll tax (O: in accordance with the word of Allah Most High,

"Fight those who do not believe in Allah and the Last Day and who forbid not what Allah and His messenger have forbidden-who do not practice the religion of truth, being of those who have been given the Book-until they pay the poll tax out of hand and are humbled" (Koran 9.29),

the time and place for which is before the final descent of Jesus (upon whom be peace). After his final coming, nothing but Islam will be accepted from them, for taking the poll tax is only effective until Jesus' descent (upon him and our Prophet be peace), which is the divinely revealed law of Muhammad. The coming of Jesus does not entail a separate divinely revealed law, for he will rule by the law of Muhammad. As for the Prophet's saying (Allah bless him and give him peace),

"I am the last, there will be no prophet after me,"

this does not contradict the final coming of Jesus (upon whom be peace), since he will not rule according to the Evangel, but as a follower of our Prophet (Allah bless him and give him peace) ).

Tafsir

What does the Caliph do? How long does he do it? How frequently does he do it? Why does he do it?
  • The caliph (o25) makes war upon Jews, Christians, and Zoroastrians
  • the war continues) until they become Muslim or else pay the non-Muslim poll tax
  • "Jihad is a communal obligation," meaning upon the Muslims each year. [O9.1]
  • Because Allah commanded it: 9:29.
That is Sharia, Islamic law. Do you give a damn? What will you do about it??

It is offensive to conduct a military expedition against hostile non-Muslims without the caliph's permission (A: though if there is no caliph (def: o25), no permission is required).



Tafsir

Islamic law prohibits conducting a military expedition against Kuffar without the Caliph's permission unless there is no Caliph. Why in Hell does the 'Religion of Peace' contemplate ghazwat against Kuffar in any case; with or without a Caliph?

Isn't Jihad supposed to be striving against temptation? Why can't they strive against temptation to rape, pillage & plunder Kuffar?

The bold red text above is Islamic law; it contradicts claims that bin Ladin's attacks are haram because they were not authorized by the Caliph. No Caliph; no need for his authorization.

O9.4: Who is Obligated to Fight in Jihad

Those called upon (O: to perform jihad when it is a communal obligation are every able bodied man who has reached puberty and is sane.

The following may not fight in jihad:

-1- Someone in debt, unless his creditor gives him leave;

-2- or someone with at least one Muslim parent, until they give their permission;

unless the Muslims are surrounded by the enemy, in which case it is permissible for them to fight without permission.

O9.1: The Obligatory Character of Jihad

Jihad is a communal obligation (def: c3.2). When enough people perform it to successfully accomplish it, it is no longer obligatory upon others (O: the evidence for which is the Prophet's saying (Allah bless him and give him peace),

"He who provides the equipment for a soldier in jihad has himself performed jihad,"

and Allah Most High having said:

"Those of the believers who are unhurt but sit behind are not equal to those who fight in Allah's path with their property and lives. Allah has preferred those who fight with their property and lives a whole degree above those who sit behind. And to each, Allah has promised great good" (Koran 4:95).

If none of those concerned perform jihad, and it does not happen at all, then everyone who is aware that it is obligatory is guilty of sin, if there was a possibility of having performed it. In the time of the Prophet (Allah bless him and give him peace) jihad was a communal obligation after his emigration (hijra) to Medina. As for subsequent times, there are two possible states in respect to non-Muslims.

The first is when they are in their own countries, in which case jihad (def: o9.8) is a communal obligation, and this is what our author is speaking of when he says, "Jihad is a communal obligation," meaning upon the Muslims each year. ...



Tafsir

As the Myth vs Fact series draws to a close, #477 is the first to quote from Islamic Jurisprudence: Sharia. The highlighted portion of the last sentence of the quote confirms the rulings of Al-Ghazali & Al-Shafi'i that the Imam must mount at least one military expedition against Kuffar in every year.

How the Hell can you know this and not curse Islam from the roof tops? Do not conceal your newly discovered knowledge, spread it; share it, make it known through out the world. Yahya related to me from Malik from Zayd ibn Aslam that Jabir ibn Abdullah al-Ansari said, "We went out with the Messenger of Allah, may Allah bless him and grant him peace, in the raid on the Banu Ammar tribe." Jabir said, "I was resting under a tree when the Messenger of Allah, may Allah bless him and grant him peace, came. I said, 'Messenger of Allah; come to the shade.' So the Messenger of Allah, may Allah bless him and grant him peace, sat down, and I stood up and went to a sack of ours. I looked in it for something and found a small cucumber and broke it. Then I brought it to the Messenger of Allah, may Allah bless him and grant him peace. He said, 'From where did you get this?' I said, 'We brought it from Madina, Messenger of Allah.' "

Jabir continued, "We had a friend of ours with us whom we used to equip to go out to guard our mounts. I gave him what was necessary and then he turned about to go to the mounts and he was wearing two threadbare cloaks of his. The Messenger of Allah, may Allah bless him and grant him peace, looked at him and said, 'Does he have two garments other than these?' I said, 'Yes, Messenger of Allah. He has two garments in the bag.' I gave them to him. He said, 'Let him go and put them on.' I let him go to put them on. As he turned to go, the Messenger of Allah, may Allah bless him and grant him peace, exclaimed, 'May Allah strike his neck. Isn't that better for him?' He said (taking him literally), 'Messenger of Allah, in the way of Allah.' The Messenger of Allah, may Allah bless him and grant him peace, said, 'In the way of Allah.' " Jabir added, "The man was killed in the way of Allah."

Yahya related to me from Malik from Rabia ibn Abi Abd ar-Rahman from Muhammad ibn Yahya ibn Habban that Ibn Muhayriz said, "I went into the mosque and saw Abu Said al-Khudri and so I sat by him and asked him about coitus interruptus. Abu Said al-Khudri said, 'We went out with the Messenger of Allah, may Allah bless him and grant him peace, on the expedition to the Banu al-Mustaliq. We took some Arabs prisoner, and we desired the women as celibacy was hard for us. We wanted the ransom, so we wanted to practise coitus interruptus. We said, 'Shall we practise coitus interruptus while the Messenger of Allah, may Allah bless him and grant him peace, is among us before we ask him?' We asked him about that and he said, 'You don't have to not do it. There is no self which is to come into existence up to the Day of Rising but that it will come into existence.' "

Yahya related to me from Malik from Ibn Shihab from Humayd ibn Abd ar-Rahman ibn Awf from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "Whoever hands over two of any type of property in the way of Allah is called to the Garden, with the words 'O slave of Allah! This is good!' Whoever is among the people of prayer, is called from the gate of prayer. Whoever is among the people of jihad is called from the gate of jihad. Whoever is among the people of sadaqa, is called from the gate of sadaqa. Whoever is among the people of fasting, is called from the gate of the well-watered. (Bab ar-Rayyan)."

Abu Bakr as-Siddiq said, "Messenger of Allah! Is it absolutely necessary that one be called from one of these gates? Can someone be called from all of these gates?" He said, "Yes, and I hope you are among them ."

So the man went around among the slain, and Sad ibn al-Rabi said to him, 'What are you doing?' The man said to him, 'The Messenger of Allah, may Allah bless him and grant him peace, sent me to bring him news of you.' He said, 'Go to him, and give him my greetings, and tell him that I have been stabbed twelve times, and am mortally wounded. Tell your people that they will have no excuse with Allah if the Messenger of Allah, may Allah bless him and grant him peace, is slain while one of them is still alive.' "
